Buying in Marbella after the golden visa
Buying a property in Marbella no longer opens the way to residence: Spain brought the golden visa to an end in 2025. Buyers from outside the EU still purchase here, with a NIE, but owning and residing, once tied together, are now two separate questions, and residence needs a permit of its own.
Enquire about thisWhat has not changed
Foreign buyers, whatever their nationality, can still own property in Spain, and the notary still asks for a NIE before the deed is signed. For non-residents the number is requested on form EX-15, at a police office in Spain or at a Spanish consulate abroad.
What has
The purchase no longer brings residence with it. If you wish to live in Marbella, the permit has to come from your own circumstances: non-lucrative residence if you will live on your means, a work-based permit if you will be employed, the family route if your partner is European.
Planning a purchase today
- Request the NIE early, before reserving, so that the deed date never waits on it
- Decide whether the property is a second home or the start of a residence, since the steps after the notary differ
- If residence is the aim, begin with the consulate route that fits you, not with the purchase
- Be wary of anyone who still presents a property purchase as a way to obtain residence
In Marbella
Whether the property is in Sierra Blanca, on the Golden Mile or in Benahavís just inland, a non-EU buyer’s NIE is processed like anyone else’s, at the Comisaría on Avenida Arias de Velasco or at a consulate. Residence has become a separate file, and we help you think it through from the first viewing.

Questions
I applied for a golden visa before it ended. Where do I stand?
Permits granted earlier, and applications made before the closure, depend on the transitional rules; a lawyer specialised in immigration can tell you where yours stands. We focus on the NIE, the TIE and the appointments that follow from your permit.
Can a company buy the property instead?
Companies can own property in Spain, and the people who sign for them generally need a NIE too. The structure is a matter for your lawyer and tax adviser; the NIE part is ours.
